“No Right to a Bike Lane”: Landmark Court Ruling

Alberta Minister of Transportation Devin Dreeshen issued a statement applauding a decision from the Ontario Court of Appeal regarding municipal bike lane regulations, calling the ruling “a win for common sense.”
“The appeal court made clear that governments have the authority to make and change transportation policy and that there is no constitutional right to a bike lane,” Dreeshen said.
The minister noted that the Ontario appellate ruling will help inform ongoing efforts by the Alberta government to craft new provincial transportation legislation.
“Albertans expect their government to make transportation decisions based on what works for our communities,” Dreeshen stated. “Our government is developing legislation to make sure transportation infrastructure works for all road users.”
Critiquing past transportation policies as being “driven by ideology rather than common sense,” Dreeshen affirmed that the province will continue to prioritize safety and quality of life when planning future road infrastructure.
